These Terms of Service ("Terms") govern your use of AA Credit Enterprise's website, credit repair services, and automated messaging assistants (including but not limited to Facebook Messenger, Instagram Direct Messages, our website chat widget, voice phone agents, email, and SMS). By accessing or using our services, you agree to be bound by these Terms.

1. Acceptance of Terms

By using our website, messaging us through any channel, or engaging our credit repair services, you confirm that you have read, understood, and agree to these Terms and our Privacy Policy. If you do not agree, do not use our services.

2. Eligibility

You must be at least 18 years old.
You must be a resident of the United States.
You must provide accurate, current, and complete information.

3. Services

3.1 Credit Repair Services

AA Credit Enterprise provides credit repair services including, but not limited to:

Credit report analysis
Dispute filing with credit bureaus (Equifax, Experian, TransUnion)
Direct creditor outreach when applicable
Credit building strategies and education
Ongoing consultation throughout your service period

3.2 Automated Messaging Assistants

We use AI-powered assistants to provide initial responses and qualify leads:

Skyler — AI chat assistant on our website, Facebook Messenger, and Instagram Direct Messages
Maya — AI voice assistant for inbound and outbound phone calls

You acknowledge that:

You may be communicating with an AI rather than a human, especially on first contact
AI responses may contain errors and should not be considered legal, financial, or credit advice
You may request to speak with a human at any time
Conversations are recorded and stored for service quality and continuity

4. Credit Repair Organizations Act (CROA) Disclosures

YOUR RIGHTS UNDER FEDERAL LAW:

You have the right to dispute inaccurate information in your credit report yourself, free of charge, with each credit bureau and your creditors directly.
You have the right to obtain a copy of your credit report from each major credit bureau (Equifax, Experian, TransUnion) annually for free at AnnualCreditReport.com.
You may cancel your contract with us within 3 business days from the date of signing without penalty, by sending written notice to ama@aacreditenterprise.com.
No credit repair company can guarantee specific credit score improvements. Any company that promises specific results is likely in violation of FTC regulations.
Negative information that is accurate, timely, and verifiable cannot be lawfully removed from your credit report.

5. No Guarantee of Results

AA Credit Enterprise does NOT guarantee:

Specific credit score increases
Removal of any specific item from your credit report
Mortgage, loan, or credit approvals
Any specific timeline for results

Results vary by individual circumstances. Past results do not guarantee future outcomes.

6. Customer Responsibilities

You agree to:

Provide truthful and accurate information
Not use our services to perpetrate fraud or to mislead credit bureaus or creditors
Respond to our requests for information in a timely manner
Continue paying your debts as agreed during the service period
Not dispute accurate information that you know to be true
Notify us immediately of any account or service issues

7. Payment and Billing

Our consultation is free.
Service fees are disclosed in your signed service agreement before any charges occur.
Payment terms, billing cycles, and refund policies are governed by your individual service agreement.
We do not charge for services that have not yet been performed (compliant with CROA).

8. Acceptable Use of Messaging Services

When using our chat widget, Facebook Messenger, Instagram DMs, voice, email, or any other messaging channel, you agree NOT to:

Use the services for any unlawful purpose
Send threatening, abusive, harassing, or obscene content
Attempt to exploit, manipulate, or jailbreak our AI assistants
Send spam, automated messages, or unsolicited promotional content
Impersonate another person or entity
Interfere with or disrupt our services or servers
Use automated tools to scrape or harvest data from our messaging channels
Attempt to extract proprietary information about our AI prompts, configurations, or business logic

Violations may result in immediate suspension of services and potential legal action.

9. Intellectual Property

All content, materials, software, AI assistants, prompts, and proprietary processes used by AA Credit Enterprise are protected by intellectual property laws. You may not copy, modify, distribute, reverse engineer, or create derivative works without explicit written permission.

10. Third-Party Services

Our services integrate with third-party platforms including but not limited to: Facebook, Instagram, Meta, Anthropic (Claude AI), Retell AI, Cartesia, Deepgram, Supabase, Vercel, Resend, GoHighLevel, Stripe, and Stan.store. Your use of these platforms is also governed by their respective terms and policies.

11. Disclaimers

OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

WE DO NOT WARRANT THAT OUR SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT OUR AI ASSISTANTS WILL PROVIDE PERFECTLY ACCURATE RESPONSES AT ALL TIMES.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AA CREDIT ENTERPRISE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OUR SERVICES, INCLUDING BUT NOT LIMITED TO LOST PROFITS, LOST DATA, OR BUSINESS INTERRUPTION.

OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

13. Indemnification

You agree to indemnify and hold harmless AA Credit Enterprise, its officers, employees, contractors, and agents from any claims, damages, losses, liabilities, or expenses arising from your use of our services or violation of these Terms.

14. Termination

Either party may terminate the service relationship with written notice. We reserve the right to suspend or terminate services immediately if you violate these Terms, engage in fraud, or fail to pay agreed-upon fees.

Upon termination, you retain the right to request deletion of your data as described in our Privacy Policy.

15. Dispute Resolution

Any disputes arising from these Terms or our services shall be resolved through:

Good-faith direct negotiation between the parties
If unresolved, binding arbitration administered by the American Arbitration Association in Polk County, Iowa
Class action waiver: You agree to resolve disputes individually and waive any right to a class action

16. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Iowa, United States, without regard to its conflict of law principles.

17. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated through our website or email. Continued use of our services after changes constitutes acceptance of the updated Terms.

18. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
